AAP Office-of-profit Case: Delhi High Court Sends Matter Back To EC; AAP MLAs Membership Restored For Now

  • The Delhi High Court has restored the membership of the 20 disqualified AAP MLAs in the office-of-profit case, for now
  • The matter is to head back to the EC which must consider each case separately

The Delhi High Court on Friday gave relief to the Aam Aadmi Party in the office-of-profit case by restoring the membership, for now, of the 20 MLAs who were disqualified by the Election Commission in the matter.

The High Court sent the matter back to the Election Commission saying that each case must be considered individually. The bench held that the reference of the President to the Election Commission is valid.

There will be another hearing.

Arvind Kejriwal tweeted on the matter:

The Congress' Ajay Maken, meanwhile, said that this was only temporary relief and that there was no reason for the AAP to celebrate.

The MLAs had petitioned the court challenging their disqualification for holding office-of-profit when they were appointed parliamentary secretaries to ministers in the Arvind Kejriwal-led Delhi government in March 2015.
